These Terms of Service govern your use of https://boatcaravan.online and your engagement of Boat Caravan Pty Ltd (ABN 82 643 386 449) for professional business and consulting services. By using this website or engaging our services, you agree to be bound by these terms. Last updated: 1 July 2025.
1. About these terms
These terms form the basis of our relationship with website visitors, prospective clients and engaged clients. Specific engagements may also be governed by a separate written proposal, statement of work or engagement letter. Where a signed engagement document conflicts with these terms, the signed engagement document prevails to the extent of the conflict.
2. Who we are
Boat Caravan Pty Ltd (ABN 82 643 386 449) is an Australian proprietary limited company based in Melbourne VIC. We provide professional business and consulting services, including business strategy, operational review, market and competitor research, financial planning support, and advisory services for small and medium enterprises across Australia.
3. Our services
The scope, deliverables, timelines and fees for each engagement are set out in the written proposal we provide before work commences. Any indicative timeframes or outcomes discussed before engagement are estimates only and do not constitute a guarantee of particular business results. Advisory information we provide is general in nature and does not constitute legal, taxation, financial product or licensed professional advice. You should obtain independent specialist advice where appropriate.
4. Quotes and engagement
- Quotes requested through our quote page are indicative until we confirm scope in writing.
- Written quotes are valid for 30 days from the date of issue unless otherwise stated.
- An engagement begins when you accept a written proposal and any required deposit has been received.
- Work outside the agreed scope will be quoted separately and only performed with your written approval.
5. Fees, invoicing and payment
- Fees are as set out in your written proposal and are stated in Australian dollars.
- Unless otherwise agreed in writing, invoices are payable within 14 days of the invoice date by direct deposit to the account details shown on the invoice.
- Invoices are issued by email to the address you nominate during engagement.
- Amounts are inclusive of GST where applicable, or GST will be itemised separately in accordance with A New Tax System (Goods and Services Tax) Act 1999 (Cth).
- Overdue amounts may attract interest and reasonable recovery costs as permitted by law.
6. Your obligations
To enable us to perform our services, you agree to provide accurate, complete and timely information, respond reasonably promptly to requests for feedback, and ensure any materials you supply to us do not infringe the rights of any third party. Delays caused by missing information or slow approvals may affect agreed timelines.
7. Australian Consumer Law and consumer guarantees
Nothing in these terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law (being Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable legislation that cannot lawfully be excluded. Where you acquire our services as a consumer under the Australian Consumer Law, our services come with guarantees that cannot be excluded, including that services will be supplied with due care and skill, will be reasonably fit for the purposes you made known to us, and will be supplied within a reasonable time. If we fail to comply with a consumer guarantee that cannot be excluded, you may be entitled to a remedy at law.
8. Limitation of liability
To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with an engagement is limited to the fees actually paid by you for the relevant services. We are not liable for indirect, incidental or consequential loss, including lost profits or lost business opportunities. This clause does not apply to liability that cannot lawfully be limited, including liability arising from breach of a consumer guarantee under the Australian Consumer Law or from anything else excluded by statute.
9. Intellectual property
Upon full payment, you own the final deliverables created specifically for your engagement. We retain ownership of our pre-existing methodologies, templates, frameworks and internal working materials, and we grant you a non-exclusive licence to use any such materials embedded in your deliverables for your own business purposes. We may reference anonymised aspects of our work in marketing materials unless you ask us in writing not to.
10. Confidentiality
We treat your business information as confidential and will not disclose it except as needed to perform the services, as required by law, or with your consent. Similarly, you agree to keep our proposals, pricing methodologies and internal materials confidential. Confidentiality obligations survive the end of an engagement.
11. Privacy
We handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. By engaging us, you consent to the collection, use and disclosure of information as described in that policy.
12. Suspension and termination
Either party may end an engagement by giving 14 days written notice, or immediately if the other party commits a material breach that is not remedied within 7 days of written notice. You remain liable for fees for work performed up to the date of termination. We may suspend work while invoices remain overdue.
13. Third-party links and tools
This website and our deliverables may refer to third-party websites, software or tools. We do not endorse or take responsibility for third-party content, and your use of third-party products is governed by their own terms.
14. Changes to these terms
We may update these terms from time to time. The current version published on this page applies to website use and to new engagements from its publication date. Existing signed engagements continue under the terms in place when they commenced unless varied in writing.
15. Governing law
These terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Victoria and any courts competent to hear appeals from them.
